What’s the number one thing a reader of a legal document is looking for? We’d like to suggest that it’s clarity! Readers of any writing — including legal documents — are looking for a document they can read once, understand, and act on.

Read the full version of a definition of plain language by the International Plain Language Federation

The award for Best Plain Language Legal Document celebrates legal writing that gets its point across without that legal flavouring that we’ve seen so often. How often have you encountered words like these in a legal document — furthermore, notwithstanding, prior to, accordingly? And what about commence, expedite, or terminate?


Let’s see some legal documents that push the boundaries of ‘plain’

The winners of the Best Plain English Legal Document in 2018, Draper Cormack, pride themselves on communicating clearly and directly with their clients. And the judges agreed that they were doing a great job of clear communication with their terms and conditions. The judges said:

This document is written in a way that gives the intended audience a strong chance of understanding it at the first reading, and in the way the drafter wants them to. It’s clear, direct writing, using as few words as needed, and avoids being ambiguous, lengthy or technical writing and complex sentences.

Overall, it is a good example of what you can do with a legal document.

The other finalists, Infinite Possibilities and Hatch, also made clarity a key feature of their communication with their customers.

And take a look at Hatch’s terms too. The judges said:

Overall this document shows what plain English can achieve in the law. The target audience is written to in a language it can understand and act upon with confidence. The flow of ideas is logical and the design is clear and concise. [The document’s audience] would easily and quickly grasp its implications.


What the judges are looking for

The judges are looking for the best example of a legal document written in plain language. You can enter a document used in legal contexts or for legal purposes. Examples include contracts, agreements, terms and conditions, notices, deeds, judgments, legal opinions, and so on. The document may cover a legally enforceable Act, process, obligation, or right.

Here are the judging criteria. And remember the judges will also be keen to know if you’ve evaluated your document in any way, such as carrying out document user-testing.

Purpose

The purpose of the document is clear at the start, and the content supports the purpose of the document.

Structure

The structure is clear and logical to the reader.

Headings and main messages

The headings are informative and clearly signpost the main messages.

Paragraphs

The paragraphs are mostly short and focused on one topic.

Sentences

The sentences are mostly short and straightforward.

Words

The words are precise and familiar. Technical terms are explained.

Layout and presentation

The layout helps the reader absorb the messages quickly and easily.

Are you one of our award-winning plain language Champions? After a break of almost 3 years, our premier Champion categories are back: Best Organisation and Best Individual or Team. The Award for Best Organisation is highly sought-after and you’ll join an elite band of past winners.

We know for sure that the judging team is looking forward to hearing about your plain language project. But how do you know whether the time is right to enter the Best Organisation category?

Here are five clues to help you decide if it’s your organisation’s time to shine. If any one of them is true, we recommend you enter!


1. Your organisation champions and celebrates clear communication

Clear communication is something your organisation values and rewards. Your leadership team walks the talk, promoting the benefits of clear communication throughout your organisation. You may even have gone the extra mile by working towards an external mark of quality like the WriteMark or WriteMark Plus.

Your internal documents, such as brand guidelines, policies, and newsletters, are written in plain language. Role descriptions emphasise the need to write clearly. Perhaps you even have formal KPIs for using plain language.

Let your industry peers know you’re a leader by entering the Champion category.


2. You’ve noticed better business results from clearer communication

You’ve got case studies or numbers that show improvement. Achieving a measurable return on your investment in business writing is evidence of Champion performance.

You recognise writing is more than an everyday activity in business — it can be a way to improve business success.

If you’ve cracked it, you deserve a medal!


3. You’ve had great feedback from customers about your communication style

Your customers value the way you communicate. Getting praise from customers for using plain language is praise indeed! People don’t offer praise lightly. They’re much more likely to complain about poor communication — or to say nothing at all.

Great feedback for your communication style shows you’re getting your message across in a way your customers appreciate.

We’d like to hear what brought about that success — and to tell the world about it!


4. You train your people in better business writing

Organisations that commit to a plain language culture offer their people resources and training. Writing in plain language takes skill and effort.

You train your staff to write clearly, which gives them a step up. They enjoy their writing more, and they write more efficiently.

Good on you for giving your people the tools they need to write well. That’s worth celebrating too!


5. Your organisation encourages peer review of print and online content

Peer review at key stages of a writing project is expected. People in your organisation seek out peer review as they can see the value in another person’s critique. Your peer review process uses a checklist or standard and is part of a defined process to achieve quality.

Reviewing and feedback can take place through user-testing too. Do you regularly seek feedback from real readers on your communications?

Good systems and processes are key to a Champion mindset. Enter the Awards and get some well-deserved external recognition for your work.

The annual Plain English Awards is a world-class event that relies on the efforts and support of a large and varied group of plain language enthusiasts. From our generous sponsors to our international panels of judges; our administrative team through to our entrants — every year we benefit from a huge amount of passion and commitment.

We acknowledge the impact of the COVID-19 pandemic on many individuals and organisations, so we’ve decided not to run the Awards this year. We’re mindful that many organisations that would normally enter may be under greater pressure than usual. And that other organisations and individuals who usually get involved with the Awards may have less availability.

Our patron, Chloe Wright, supports the decision: ‘I think this option makes sense for this year,’ she says. ‘So many difficult decisions have had to be made over the past few months. We must look to a different and better future by coming through COVID shaken but whole.’

We’ll be ready to roll again when the time’s right

Although we’re not running the Awards this year, we will be back soon. We’ve loved the wonderful examples of plain English that we’ve seen being used both in New Zealand and overseas to communicate clearly during the pandemic. This heightened interest in clear communication gives us an extra incentive to get back up and running when the time’s right.

We look forward to celebrating the efforts of so many communicators at such an important time. So hold on to your entries — we won’t be hosting the Awards for a while, but we’ll make sure you can enter projects you’re especially proud of from your work in 2020.

On 31 March 1889 Gustave Eiffel’s tower opened in Paris. On 31 March 1959, the Dalai Lama trekked across the Himalayan Mountains from Lhasa to seek asylum in India. On 31 March 2011, a deadly Egyptian cobra was found alive one week after escaping the reptile house at New York’s Bronx zoo.

On 31 March this year, New Zealand’s Oscars for clear communication turns on the lights and rolls out the fancy carpet for entries in the 2020 Plain English Awards.

Everyone’s a winner

The Awards recognise outstanding efforts in communicating clearly. They’re proof of the power of good communication in doing good.

While the winners get rightful recognition, the real winners are the people and communities who get the information they need. And people feel good when they know what a writer is trying to say and that has their interests at heart.

This year the Plain English Awards has 13 categories open. The Plain English Awards Trust is looking forward to receiving quality entries across all these categories.

More than prizes

Apart from the accolades and feathers in caps for winning, past finalists have found that they gained a huge amount even from the judges’ comments they received. Feedback from an anonymous survey of entrants referenced the value of this feedback.

‘The judge’s feedback is priceless – WOW… whatever we paid to enter is nothing compared to that feedback document.’

The Awards get great publicity each year and help boost awareness that the public doesn’t need to put up with poorly written information.
Winners also benefit by being seen as an attractive organisation that can lure strong writers and talented team members.

‘It reinforces that we don’t just say that we communicate with people in clear and plain language — that we actually do.’

You can see your effort has paid off

Writing in plain English and winning an award for your craft can be like mountain climbing. The effort is immense, but the views from the top are crystal clear.

You’re in for a plain English treat over the next couple of years. This year we’re pushing the People’s Choice Awards to the fore (we’ll be back with the full Awards next year). So right now, in 2019, we’re giving all of you in the public domain the chance to nominate your most and least favourite communications.

Here are three great reasons to get involved this year.


You want to do something about frustratingly confusing communications

When you nominate a communication for the not-so-coveted Brainstrain award, you’ll be helping to make a positive difference to the way organisations communicate. Almost without exception, organisations step up to ‘take it on the chin’ when nominated for the dreaded bin of sour worm lollies. With the public scrutiny they get from winning the Brainstrain category, they’re motivated to change.


You want to share a wonderful example of clear communication with the world

We love to celebrate the great work happening in so many organisations that are improving the way they communicate. Winning the award for Best Plain English Communication is a public pat on the back for New Zealand’s clearest communicators. Help them get the recognition they deserve.


You want to help improve the lives of everyday Kiwis

The People’s Choice Awards help organisations to keep things real with their communications. If they win the Best Plain English Communication award, they’re recognised for getting things right for their audience. If, however, they win the dreaded Brainstrain award, they have plenty of incentive to change for the good.

We’re ready to roll with the Awards in 2019 — and we’ve got some exciting plans to tell you about.


We’ll alternate between the Plain English Awards and the People’s Choice Awards

As you might imagine, it takes a tonne of support and time and resources to bring together annual awards. We’re now in our 14th year, and we know that our momentum is strong and that people’s appetite for plain English continues to grow.

After lots of planning and consideration, we’ve decided to alternate between having the full Plain English Awards one year and the People’s Choice Awards the next. Having held the full Awards last year in 2018, this means we’re focusing on the People’s Choice only in 2019.

Some of you will remember that the idea of holding the People’s Choice Awards on their own is actually not a new one. You may recall we held them on their own in 2016, to coincide with the Clarity2016 conference here in Wellington.


Entries for this year’s People’s Choice Awards will open on Saturday, 1 June

Once entries are open, members of the public will be able to nominate an outstanding communication of their choice for the People’s Choice — Best Plain English Communication.

People will also be able to nominate a miserable communication for the notorious People’s Choice — Worst Brainstrain Communication.

Entries in the People’s Choice Awards are free and will be judged by a panel of plain language specialists from New Zealand and overseas.


We’re planning a mid-year Awards ceremony

Another result of our planning is that we’ve decided to aim for a mid-year ceremony. Traditionally we’ve celebrated our winners in November. However, after this year, entries will open near the end of the year and we’ll celebrate winners the following winter. Because who doesn’t love a good mid-winter celebration?!

Entries for the 2020 Plain English Awards will open in November this year. We’ll give you plenty of information before then, so keep your eye out for our newsletters and other publicity. Subscribe to our newsletter
